Privacy Policy
1. Definitions
- “Auckland Air Solutions”, “we”, “us”, or “our” means Auckland Air Solutions and its employees, contractors, or agents.
- “Customer” means the person or entity requesting or receiving Goods and Services from Auckland Air Solutions.
- “Goods and Services” means all equipment, materials, parts, labour, installation, servicing, maintenance, repairs, advice, and associated work supplied by Auckland Air Solutions.
- “Price” means the agreed price for the Goods and Services, including GST unless stated otherwise.
2. Acceptance of Terms
- Acceptance of a quotation, confirmation to proceed, payment of a deposit, or instruction to commence work constitutes acceptance of these Terms & Conditions.
- These Terms apply to all Goods and Services supplied by Auckland Air Solutions unless otherwise agreed in writing.
3. Quotations
- All quotations are valid for 30 days from the date of issue unless stated otherwise.
- Quotations are based on information available and site conditions visible at the time of quoting.
- Auckland Air Solutions may withdraw or amend a quotation at any time prior to commencement of work.
4. Scope of Work & Variations
- Standard back-to-back heat pump installations include up to 3 metres of pipework, unless otherwise specified in writing.
- Any additional pipework, materials, labour, or services required beyond the quoted scope will be charged separately.
- Variations must be approved by the Customer and may result in adjusted pricing and timelines.
5. Access, Heights & Site Conditions
- The Customer must provide safe, clear, and unrestricted access to the installation area.
- Installations above 5 metres may require specialised access equipment such as scaffolding, scissor lifts, or hydraulic lifts and will incur additional charges.
- Hire equipment and associated labour costs will be charged at supplier rates.
- If actual site conditions differ materially from those disclosed or reasonably observable, Auckland Air Solutions reserves the right to revise pricing or delay works.
6. Customer Responsibilities & Approvals
- The Customer confirms they are the property owner or have written authorisation from the owner to proceed.
- For apartments or multi-unit buildings, Body Corporate or Building Manager approval must be obtained prior to installation.
- Any delays or costs arising from missing approvals, restricted access, or inaccurate information provided by the Customer are the Customer’s responsibility.
7. Payment Terms
Hi-Wall Heat Pumps
- 50% deposit required prior to commencement
- Remaining balance payable within 3 days of completion
Ducted Systems & Larger Projects
- 50% deposit required prior to commencement
- 25% payable prior to second fix
- Final 25% payable within 3 days of completion
- Auckland Air Solutions may withhold commissioning, documentation, or compliance certificates (including Electrical Certificate of Compliance) until full payment is received.
8. Late Payment & Recovery
- Overdue amounts may incur interest at 8% above the prevailing bank lending rate, calculated daily from the due date.
- The Customer is responsible for all reasonable costs incurred in recovering overdue amounts, including legal and debt collection fees.
- Auckland Air Solutions may suspend or terminate work if payment obligations are not met.
9. Ownership & Risk
- Risk in the Goods passes to the Customer upon delivery or installation.
- Ownership of all Goods remains with Auckland Air Solutions until full payment for all Goods and Services has been received.
- Where legally permitted, Auckland Air Solutions may recover unpaid Goods.
10. Delays & Force Majeure
- Auckland Air Solutions is not liable for delays caused by events beyond reasonable control, including weather, supplier delays, access limitations, or acts or omissions of the Customer.
- Where delays are caused by the Customer, Auckland Air Solutions may invoice for work completed and associated costs.
11. Warranty
- Equipment supplied is covered by the applicable manufacturer’s warranty.
- Workmanship is warranted for the period specified in the quotation or invoice.
- Warranty does not cover misuse, lack of maintenance, power supply issues, third-party interference, or unauthorised modifications.
12. Consumer Guarantees Act 1993
- Nothing in these Terms limits or excludes any rights the Customer may have under the Consumer Guarantees Act 1993 where that Act applies.
- Where the Customer acquires the Goods and Services for business purposes, the Customer agrees that the Consumer Guarantees Act 1993 does not apply, to the fullest extent permitted by law.
- Where the Consumer Guarantees Act 1993 applies, Auckland Air Solutions’ liability is limited to the remedies provided under that Act.
13. Liability
- To the extent permitted by law, Auckland Air Solutions is not liable for any indirect, incidental, or consequential loss arising from the supply of Goods and Services.
- Nothing in these Terms limits liability that cannot legally be excluded.
14. Default
- The Customer will be in default if payment is not made when due, the Customer indicates inability or refusal to pay, or becomes insolvent.
- Auckland Air Solutions may suspend work, terminate the contract, and pursue recovery through legal or debt collection processes.
15. General
- Failure to enforce any right does not constitute a waiver of that right.
- If any provision is unenforceable, the remaining provisions remain valid.
- These Terms are governed by the laws of New Zealand.
